According to the breaking news, Judge Torres has granted the SEC's request to file an interim appeal in the Ripple case.
The following statements were included in the official document published:
The court examined the parties' letters dated 9 and 16 August 2023.
- The SEC's request for permission to file an appeal has been ACCEPTED;
- The SEC will submit its request by August 18, 2023;
- By September 8, 2023, the SEC will submit its response, if any.
Torres simply accepted the application request. Now the SEC will need to come up with a convincing justification to present it to the Second Circuit. Ripple will also have the opportunity to file its appeal against the appeal, which Second Circuit will consider.
