According to the breaking news, the SEC has officially submitted a request for leave to appeal Judge Torres' decision in the Ripple case.
The SEC used the following statements in its petition:
“The Plaintiff Securities and Exchange Commission (“SEC”) respectfully submitted to the Court on August 18, 2023, pursuant to 28 USC § 1292(b), that certain provisions of the Court's summary judgment of July 13, 2023 be upheld for provisional appeal. the plaintiff SEC presents this request to Ms. Analisa Torres.”
In his statement yesterday, Judge Torres gave the SEC the right to appeal the summary decision and requested that it exercise this right with today's deadline.
Excluding the general decline experienced yesterday, the XRP price did not experience much movement in the face of this development.
Attorney John E. Deaton commented on this development:
“This event is a request by Judge Torres to allow an appeal to the 2nd Circuit of the decision by the SEC regarding the Programmatic and Other Sales of XRP. It does not imply any real appeal, and it has nothing to do with the fact that the XRP token is not a security.”
